5. Content and Intellectual Property

You retain ownership of the product information, brand assets, and other materials you provide to the Service ("Your Content"). By using the Service, you grant us a license to use Your Content solely for the purpose of providing the Service to you.

Generated Content

Ad creatives generated by the Service using Your Content are owned by you. You may use generated content for your advertising purposes without restriction.

Our Content

The Service, including its design, features, AI models, and underlying technology, is owned by Kotoh and protected by intellectual property laws.

6. Third-Party Integrations

The Service integrates with third-party platforms including Facebook/Meta. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

When you connect your Facebook account, you authorize us to access and use data from your Facebook Ads account in accordance with our Privacy Policy and Facebook's Platform Terms.

7. Fees and Payment

The Service may be offered under various pricing plans. You agree to pay all applicable fees as described in your service agreement. Fees are non-refundable unless otherwise specified.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Generated content will achieve any particular advertising results
• Generated content will comply with all advertising platform policies
• AI-generated images will be free from artifacts or imperfections

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOTOH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kotoh and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
